Privacy Terms for Personal Information

In order to use the “Telegram Notifications” application for Bitrix24 (the “Company Product”), the provision to the Company and/or processing of personal information may be required. These Privacy Terms explain how such information is used. Please read these Privacy Terms carefully and ask questions if necessary.

These Privacy Terms govern the relations between the Company and any individual, sole proprietor or legal entity (the “User”) regarding the processing of personal information, including, without limitation, the collection, use, storage and security of information provided by the User and/or collected from the User. These Privacy Terms apply to all information that the Company and/or its affiliated or authorized persons acting on behalf of the Company may obtain about the User while the User is using the Company Product.

Please note that use of the Company Product means Your full agreement with all provisions of these Privacy Terms and the conditions for processing Your personal information specified herein. If You do not unconditionally accept all provisions of these Privacy Terms, You are not entitled to use the Company Product and must stop using it and remove it from Your Bitrix24 portal.

1. Personal information collected and processed by the Company under these Privacy Terms

For the purposes of these Privacy Terms, personal information means:

1.1.

Information, including but not limited to personal data, that the User independently provides to the Company when performing actions aimed at installation, activation, configuration and use of the Company Product, as well as when contacting support. Such information may include surname, first name, contact details, account information, data submitted through forms, requests and messages.

1.2.

Information automatically obtained when the User uses the Company Product, including technical data, browser and device information, interface activity, information from cookies and similar technologies, request data, error logs and usage events, where such data is necessary for operation, improvement and support of the Company Product.

1.3.

User data means any information uploaded, entered, processed or transmitted by the User while using the Company Product, including Bitrix24 user data, Telegram ID, username, bot-related data, webhook data, mappings between Bitrix24 users and Telegram users or chats, and any other data required for operation of the Company Product.

1.4.

Any other information about the User that the Company receives solely for the purposes specified in Section 2 of these Privacy Terms.

2. Purposes of collection and processing of users’ personal information

Collection, storage and processing of the information specified in Section 1 of these Privacy Terms is carried out solely for the following purposes:

2.1.

To identify the User when using the Company Product.

2.2.

To personalize the use of the Company Product, record user actions, save user settings, and ensure proper functioning of interfaces and specific features, including through the use of cookies and similar technologies.

2.3.

To interact with the User within the framework of agreements, contracts and license terms concluded with the Company, as well as to provide technical support.

2.4.

To ensure the operation of the Company Product for its intended purpose, including configuration and use of Telegram bots for notifications, management of bot settings, enabling and disabling webhook, matching Bitrix24 users with Telegram users and chats, and handling and support of notifications.

2.5.

To conduct statistical and other research based on anonymized data, as well as to analyze the stability, performance and quality of the Company Product.

2.6.

To comply with the laws of the Russian Federation and to protect the rights and legitimate interests of the Company and third parties.

3. Conditions of processing personal information and its transfer to third parties

3.1.

Storage, use, modification and deletion of users’ personal information is carried out in accordance with the functional purpose of the Company Product, its technical documentation, the License Agreement for its use, and these Privacy Terms.

3.2.

Disclosure of personal information to third parties is carried out in the following cases:

3.2.1.

The User has given prior consent to such disclosure.

3.2.2.

The transfer is necessary for the performance of an agreement to which the User is a party, beneficiary or guarantor, as well as for the conclusion of an agreement at the User’s initiative or an agreement under which the User will be a beneficiary or guarantor.

3.2.3.

The transfer is necessary for the operation of the Company Product for its intended purpose, including interaction with the infrastructure and APIs of Bitrix24, Telegram and other related services used by the User.

3.2.4.

The transfer is necessary for the protection of the rights and legitimate interests of the Company or third parties where the User violates the Company’s rights and/or the applicable License Agreement.

3.2.5.

The transfer is necessary for the administration of justice, execution of a court act, act of another authority or official subject to enforcement in accordance with the legislation of the Russian Federation, or in other cases provided by applicable law.

3.3.

When processing users’ personal data, the Company shall be guided by the legislation of the Russian Federation, including Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data”.

4. Limitation of liability

4.1.

The Company does not initiate the placement of personal information when the Company Product is used and does not verify its accuracy or relevance, but reserves the right to request confirmation of the accuracy of the information provided where necessary for performance of obligations, support or compliance with law.

4.2.

When placing or providing the Company with personal information of third parties, the User warrants that the User has obtained all necessary rights, permissions and consents for such actions and further warrants that such persons are informed of the applicable data processing terms.

4.3.

The Company cannot guarantee the confidentiality of personal information if such information has become publicly available by the User’s own will or due to the specifics of external services used by the User together with the Company Product, including Bitrix24 and Telegram.

4.4.

The Company shall not be liable for processing, storage or protection of data on the side of Bitrix24, Telegram or other third-party services where such processing is carried out not by the Company but by the relevant operators of such services.

5. Protection of personal information

The Company takes necessary legal, organizational and technical measures, or ensures their adoption, to protect personal information against unauthorized or accidental access, destruction, alteration, blocking, copying, provision, dissemination, and any other unlawful actions regarding personal information.

In particular, the Company:

• restricts access to personal information to authorized persons only;
• applies protection measures for authorized sessions and access to services;
• uses up-to-date technical means and security settings necessary for operation of the Company Product;
• takes measures to prevent unauthorized access to data;
• continuously improves methods of data collection, storage and processing within reasonable technical and organizational necessity.

6. Final provisions

These Privacy Terms may be amended by the Company unilaterally by publishing a new version on the Internet at: https://sergey-spirin.ru/era-solution. In the event of any discrepancy between these Privacy Terms and the License Agreement with the User, the License Agreement shall prevail.
